Abstract

Autorsko djelo pripada autoru koji ga je stvorio, a to po prirodi stvari može biti samo naravna (fizička) osoba. Tuđa autorska djela smiju se koristiti samo na temelju posebne pravne osnove, bilo suglasnosti autora djela ili zakonske odredbe koja neposredno dopušta korištenje tuđeg autorskog djela. Porastom uloge informacija u društvu, naročito digitalnih, raste značenje autorskog prava i zaštite intelektualnog stvaralaštva. U Hrvatskoj, problem autorskog prava još nije dovoljno razrađen u fotografskoj teoriji i praksi, pa se postavljaju neka specifična pitanja vezana uz primjenu autorskog prava kao npr. pod kojim uvjetima se smije koristiti fotografija kao autorsko djelo, do koje granice se smije reproducirati, koji dijelovi i pod kojim uvjetima se smiju koristiti, problem fotokopiranja, krađe i dr.

Abstract in english:	An authorial work belongs to the author that has created it and that can, in the nature of things, be only natural ( physical) person. Somebody else´s authorial works can only be used based on the specific legal foundation, whether that is a consent of the author of the work, or legal regulation that directly allows the use of somebody else´s authorial work. According to the growth of the role of information in society, particularly digital, grows the significance of the authorial work and the protection of intellectual creativity. In Croatia, the problem of the authorial work in photographic theory and practice hasn´t been adequately elaborated yet. Therefore, some specific questions related to the application of the authorial copyright have been asked. For example; under which conditions can a photograph be used as an authorial work, to which limit can it be reproduced, which parts and under which conditions can be used, the problem of photocopying, stealing etc.
