Abstract
U Hrvatskoj je zaštita autorskih prava autora-fotografa regulirana Zakonom o autorskom pravu. Autorsko djelo pripada autoru koji ga je stvorio, po prirodi stvari to može biti samo (naravna) fizička osoba. Zakonom o autorskom pravu definiraju se imovinska i moralna prava koja kažu da prilikom svakog iskorištavanja autorskog djela druge osobe (isključivo po odobrenju autora), autoru pripada naknada, te autor ima pravo biti priznan i označen kao tvorac djela. Fotografija je jedan od najvažnijih elemenata u prenošenju vijesti, posebno u dnevnim novinama. Potpisom pod fotografiju, kao dokazom autorskog djela, daje se kredibilitet samoj vijesti i novinama. U ozbiljnim novinama nezamislivo je ne potpisati autora teksta, ali isto pravilo često ne vrijedi i za autora fotografije. U ovom završnom radu biti će govora o tome koliko se često događa kršenje autorskog prava na primjeru dnevnih nacionalnih novina Večernjeg lista i Jutarnjeg lista, prije i nakon ulaska Hrvatske u Europsku uniju 1. srpnja 2013. godine.

Abstract in english: | In Croatia, the protection of copyright of the author-photographer is regulated by copyright laws. Authorship on photographs belongs to the author who created it, in the nature of things, it can be only physical person. Copyright law defines property and moral rights which say that every time the work of another person is exploited (only with the approval of the author himself), the author is entitled to compensation and he has the right to be recognized and designated as the creator of the work. Photography is one of the most important elements in the transmission of news, especially in the daily newspapers. By signing the photo credit line, as proof of the author's work, the credibility is given to the news itself and the newspapers. In serious newspaper it is unthinkable not to sign the author of the article, but the same rule often doesn’t applies to the author of the photograph. In this final work it will be discussed how often copyright infringement happens, in the case of daily national newspapers Večernji list and Jutarnji list, before and after the croatian accession to the European union on 1 July 2013. |
